These Terms and Conditions (“Terms”) govern your use of the website clarityfx.com, the client area at my.clarityfx.com, any trading account you open with us, and the trading platform we make available. They are an agreement between you and Clarity FX, with its registered office at Ground Floor, The Sotheby Building, Rodney Village, Rodney Bay, Gros-Islet, Saint Lucia (“Clarity FX”, “we”, “us”, “our”).
The following documents form part of these Terms and apply to your account: our Risk Disclosure, KYC Policy, AML Policy, Privacy Policy and Complaints Policy. By opening an account or using our services, you confirm that you have read, understood and agree to these Terms. If you do not agree, do not use our services.
To open and use an account you must:
It is your responsibility to ensure that using our services is lawful in your country. We may refuse any application without giving reasons.
You must provide accurate, complete and current information when you register and keep it up to date. We are required to verify your identity in line with our KYC and AML policies, using our verification provider. Verification must be completed before any withdrawal can be processed, and we may require it earlier. We may limit, suspend or close your account if you do not provide the information we request or if we cannot verify it. You may hold only one live account unless we agree otherwise.
Demo accounts use virtual funds for practice only. Demo results do not reflect live trading conditions and are not a guarantee of future performance. Demo balances have no monetary value and cannot be withdrawn. We may reset or close demo accounts at any time.
We provide execution-only access to leveraged over-the-counter contracts on forex and crypto pairs. We do not provide investment advice, portfolio management or recommendations, and we do not take into account your personal circumstances when executing your orders. You are solely responsible for your trading decisions. Educational content on our website is general information only.
Trading is carried out on the TradeLocker platform, which is provided by a third party and made available to you under a licence. Your login credentials are sent to you by email when your account is created. You must keep your credentials confidential and are responsible for all activity carried out using them. Tell us immediately if you believe your account has been accessed without your permission.
We aim to keep the platform available but do not guarantee uninterrupted or error-free access. The platform may be unavailable during maintenance, outages or events outside our control.
If a trade is opened or closed at a price that is clearly wrong, for example because of a technical fault, a quote that does not reflect the market, or a human error (a “manifest error”), we may adjust the trade to the correct market price or cancel it. We will act fairly and tell you as soon as reasonably possible.
You must maintain sufficient margin in your account to support your open positions. Margin requirements and leverage may vary by instrument and may be changed by us, including during periods of high volatility or around market events. If your margin level falls below the required level, your positions may be closed automatically without notice at the prevailing market price. You are responsible for monitoring your account at all times. Losses can exceed your deposits.
Trading costs may include spreads, commissions and overnight financing (swaps), which are shown on the platform or in the client area. We may change our fees and charges, and will give notice of changes where reasonably possible. You are responsible for any taxes due on your trading activity.
We do not offer bonuses unless expressly stated. Any promotion will be subject to its own terms, which will apply in addition to these Terms.
You must not use our services:
If we reasonably believe you have engaged in a prohibited activity, we may cancel or adjust affected trades, withhold related profits, restrict or close your account, and report the matter to the authorities where required.
You may close your account at any time by contacting us, once all positions are closed and any amounts you owe are settled. We may suspend or close your account, with or without notice, if you breach these Terms, if we are required to by law, if we suspect fraud or financial crime, or if continuing to provide services would expose us to legal or regulatory risk. On closure, we will return any remaining balance to you, subject to completion of verification and deduction of any amounts you owe.
All content on our website and in the client area, including text, graphics, logos and software, belongs to us or our licensors. You may use it only for your personal, non-commercial use of our services. The TradeLocker platform is the property of its owner and is licensed for use with your account.
To the fullest extent permitted by law, we are not liable for any loss arising from: market movements or trading decisions; delays, interruptions or failures of the platform, internet or third-party systems; events outside our reasonable control; your failure to keep your credentials secure; or acting on instructions given through your account. We are not liable for any indirect or consequential loss, or for loss of profit or opportunity. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud.
You agree to indemnify Clarity FX against any losses, costs or claims arising from your breach of these Terms, your misuse of our services or your violation of any law or third-party rights.
We are not responsible for any failure or delay in performing our obligations caused by events beyond our reasonable control, including market disruption or suspension, failures of liquidity providers, blockchain networks or exchanges, cyber-attacks, power or communication failures, natural disasters, war, or changes in law. In such events we may take reasonable steps, including suspending trading or closing positions at a fair price.
We communicate with you electronically, including by email, through the client area and through the platform. Notices sent to the email address on your account are treated as received when sent. Our contact address is support@clarityfx.com.
If you are unhappy with our service, please follow our Complaints Policy.
We may update these Terms from time to time. The current version, with its last-updated date, is always published on this page. Where changes are material, we will notify you in advance where reasonably possible. Continuing to use our services after changes take effect means you accept the updated Terms.
If any part of these Terms is found to be unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver of it. You may not transfer your rights under these Terms without our consent. These Terms are the entire agreement between you and us about our services.
These Terms are governed by the laws of Saint Lucia. Any dispute arising from or in connection with these Terms will be subject to the jurisdiction of the courts of Saint Lucia.
